Welcome to EduLand! By using our app, you agree to these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By accessing or using EduLand ("Service," "App," "we," "us," or "our"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

2. Eligibility

To use EduLand, you must:

Be at least 16 years of age
Be a student enrolled in an educational institution
Provide accurate information during registration
Comply with all applicable laws

By creating an account, you represent and warrant that you meet these requirements. We reserve the right to verify your student status and age at any time.

3. Account Security

You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access

We are not liable for any loss or damage arising from your failure to protect your account.

4. Acceptable Use

EduLand is intended for:

✅ Educational purposes - Connect with fellow students ✅ Marketplace - Buy and sell student items ✅ Campus events - Organize and join student activities ✅ Anonymous chat - Private and respectful communication

5. Prohibited Content and Conduct

We have ZERO TOLERANCE for:

🚫 Sexual content, exploitation, or solicitation 🚫 Child abuse, exploitation, or grooming 🚫 Hate speech, discrimination, or racism 🚫 Violence, threats, terrorism, or self-harm content 🚫 Illegal activities or controlled substances

Other violations include:

Spam, phishing, or commercial solicitation
Impersonation, identity fraud, or catfishing
Doxxing or sharing others' private information
Copyright, trademark, or intellectual property infringement
Fake news, misinformation, or election manipulation
Harassment, bullying, or targeted abuse
Evading bans by creating new accounts
Automated access (bots, scrapers) without permission
Reverse engineering or attempting to hack the Service

6. Enforcement and Consequences

Violations will result in:

Minor violations:

1st violation - Warning
2nd violation - Temporary suspension (7-30 days)
3rd violation - Permanent ban

Serious violations (sexual content, child exploitation, violence, terrorism):

Immediate permanent ban
Report to law enforcement when required by law
Preservation of evidence for legal proceedings

We reserve the right to take action without prior warning for severe violations.

7. User Content

Your Rights

You retain ownership of content you create (messages, listings, posts, photos)
You retain all intellectual property rights to your content

License to EduLand

By posting content, you grant EduLand a worldwide, non-exclusive, royalty-free, transferable license to:

Display, reproduce, and distribute your content within the Service
Moderate, edit, or remove content that violates our policies
Use anonymized, aggregated data for analytics and service improvement

This license ends when you delete your content or account, except for content shared with other users (e.g., messages they received).

Your Responsibilities

You represent and warrant that your content:

Does not violate any laws or third-party rights
Does not infringe copyrights, trademarks, or other intellectual property
Complies with these Terms and Community Guidelines

You agree to indemnify EduLand against claims arising from your content.

8. EduLand's Intellectual Property

The Service, including its design, features, logos, and code, is owned by EduLand and protected by intellectual property laws. You may not:

Copy, modify, or create derivative works
Reverse engineer or decompile the app
Remove copyright or trademark notices
Use our trademarks without written permission

9. Moderation Rights

EduLand reserves the right to:

Remove, hide, or edit any content at our discretion
Suspend or terminate user accounts with or without notice
Report illegal activity to law enforcement
Investigate violations and preserve evidence
Refuse service to anyone for any reason

We are not obligated to monitor content but may do so. We are not responsible for user-generated content.

10. Marketplace Rules

When using the marketplace:

Seller Obligations

Accurate listings - No fake, misleading, or deceptive items
Legal items only - No prohibited or stolen goods
Fair pricing - No scams or predatory pricing
Honest descriptions - Disclose all defects or issues

Buyer Obligations

Safe transactions - Meet in public places, use secure payment methods
Respectful negotiation - No harassment or lowball offers

Prohibited Items

Drugs, alcohol, tobacco, or controlled substances
Weapons, explosives, or dangerous items
Stolen or counterfeit goods
Adult content or services
Prescription medications
Hazardous materials

Important Notice

EduLand is NOT a party to marketplace transactions. We:

Do not guarantee item quality or accuracy
Are not responsible for disputes between buyers and sellers
Do not handle payments or shipping
Are not liable for fraud, scams, or theft

Transact at your own risk. We recommend meeting in safe public places and inspecting items before purchase.

11. Third-Party Services and Links

The Service may contain links to third-party websites, services, or resources. We are not responsible for:

The availability or accuracy of external content
Third-party privacy practices or terms
Any damages arising from third-party interactions

You access third-party services at your own risk.

12. Disclaimers and Limitation of Liability

Service "As Is"

EduLand is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

Merchantability or fitness for a particular purpose
Non-infringement
Uninterrupted, error-free, or secure operation
Accuracy or reliability of content

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EDULAND AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or goodwill
Service interruptions, downtime, or data loss
User-generated content or marketplace transactions
Third-party conduct or content
Unauthorized access to your account

MAXIMUM LIABILITY: Our total liability is limited to the amount you paid to use EduLand in the past 12 months (currently $0).

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless EduLand and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

Your use of the Service
Your content or conduct
Your violation of these Terms
Your violation of any laws or third-party rights

14. Privacy

Your privacy is important to us. Please review our Privacy Policy for information on how we collect, use, and protect your data.

15. Changes to Service

We reserve the right to:

Modify, suspend, or discontinue any feature at any time
Introduce new features (including paid features)
Change pricing or fee structures with 30 days' notice

We will attempt to notify you of significant changes but are not obligated to do so.

16. Changes to Terms

We may modify these Terms at any time. When we make material changes, we will:

Post updated Terms in the app with a new "Effective Date"
Notify you via in-app notification or email
Provide at least 30 days' notice for material changes

Your continued use of the Service after changes take effect constitutes acceptance. If you do not agree to the new Terms, you must stop using the Service and delete your account.

17. Termination

By You

You may terminate your account at any time through the app settings. Upon termination:

Your account and data will be deleted per our Privacy Policy
You will lose access to all content and services
These Terms will no longer apply, except for sections that survive termination

By Us

We may suspend or terminate your account immediately if:

You violate these Terms or Community Guidelines
You engage in illegal activity
You abuse, harass, or harm other users
We are required to do so by law
We discontinue the Service

We are not liable for any damages resulting from account termination.

Survival

The following sections survive termination: User Content (license), Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and Dispute Resolution.

18. Dispute Resolution

Informal Resolution

Before filing a legal claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.

Arbitration (Optional)

For disputes that cannot be resolved informally, you may elect binding arbitration under Turkish law. The arbitration will be conducted in English or Turkish, and the arbitrator's decision is final.

Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions or representative proceedings.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Turkey, without regard to conflict of law principles.

Any disputes shall be resolved exclusively in the courts of Istanbul, Turkey.

For EU users: Nothing in these Terms affects your statutory rights under EU consumer protection laws or your right to bring proceedings in your country of residence.

20. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including:

Natural disasters, pandemics, or acts of God
War, terrorism, or civil unrest
Government actions or regulations
Network or infrastructure failures

21. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid.

22. Entire Agreement

These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and EduLand regarding the Service. They supersede all prior agreements or understandings.

23. No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by us.

24. Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms to any affiliate or successor without restriction.
